Acceptable use policy

Effective date: 27 July 2026. This policy sets out what may and may not be run on Advika Data Center Services Pvt. Ltd. infrastructure. It exists to keep the shared network usable and lawful for every customer on it.

This policy forms part of the terms of service. It applies to every service we supply, including cloud VPS, dedicated servers, protected network services and any resold or managed capacity. If you allow others to use your service, you remain responsible for their conduct under this policy.

1. Prohibited content and activity

You must not use the services to store, transmit, host or link to:

  • Material that is unlawful under the laws of India, including the Information Technology Act, 2000 and rules made under it.
  • Child sexual abuse material. Any such report is treated as an immediate suspension event and is referred to the appropriate authorities.
  • Content that infringes copyright, trademarks, patents or other intellectual property rights.
  • Material that incites violence, terrorism, or hatred against a person or group.
  • Fraudulent, deceptive or impersonating content, including phishing pages and fake payment portals.
  • Malware, ransomware, spyware, exploit kits, botnet controllers or credential-harvesting infrastructure.

2. Network abuse

The following are prohibited whether directed at our network or launched from it towards a third party:

  • Denial-of-service or distributed denial-of-service traffic, amplification and reflection attacks.
  • Port scanning, vulnerability scanning or penetration testing of systems you do not own, without documented written authorisation from the owner.
  • Unauthorised access attempts, credential stuffing and brute-force authentication attacks.
  • IP address spoofing, route hijacking, forged packet headers and unauthorised BGP announcements.
  • Traffic patterns that degrade service for other customers, whether deliberate or the result of misconfiguration.
  • Operating open resolvers, open relays or open proxies that can be used for amplification.

3. Email and messaging

  • Unsolicited bulk email is prohibited. Recipients must have given verifiable consent.
  • Mailing lists must operate on confirmed opt-in and must honour unsubscribe requests promptly.
  • Forged headers, misleading sender identities and false routing information are prohibited.
  • Harvesting addresses, or purchasing harvested lists, is prohibited.
  • Outbound mail volume may be rate-limited by default. Higher limits are considered case by case against sending reputation.

4. Resource use

Virtual servers share physical hosts. Sustained use that materially degrades neighbouring services may result in throttling, migration or a request that you move to a larger plan or to dedicated hardware. Where the intended workload is known to be resource-intensive, tell us before ordering so the right platform is selected.

  • Cryptocurrency mining, and proof-of-work processing generally, is not permitted on shared virtual plans without prior written approval.
  • Public file-sharing, torrent tracker and seedbox operation is not permitted on shared virtual plans.
  • Storage services must not be used purely as a remote backup dump for unrelated third parties in a way that is inconsistent with the plan purchased.

5. Security responsibilities

On unmanaged services, operating system and application security is yours to maintain. You are expected to apply security updates within a reasonable period, use strong authentication and restrict administrative access, remove or secure default accounts and unused services, and monitor for compromise. A compromised server that begins attacking others is treated under this policy as though the abuse were intentional, because the effect on the network is identical.

6. Reporting abuse

Suspected abuse originating from our network may be reported to [email protected]. Include timestamps with the applicable time zone, source and destination IP addresses, and relevant log extracts. Reports without evidence sufficient to identify the traffic cannot be actioned.

7. Enforcement

Our response is proportionate to the severity and the risk to other customers:

  • Notice. For most first reports, we contact you and set a period to correct the issue.
  • Filtering or throttling. Where traffic is harming the network, we may filter or rate-limit it while the issue is resolved.
  • Suspension. Where harm is ongoing, severe or unaddressed, the service may be suspended.
  • Immediate suspension without notice. Reserved for active attacks, child sexual abuse material, and cases where a lawful authority directs it.
  • Termination. For repeated or serious breach. Fees paid for a service terminated for breach are not refundable.

8. Lawful requests and cooperation

We comply with lawful orders from Indian courts and competent authorities, and we may preserve and disclose data where legally required. Where we are permitted to notify you of a request affecting your service, we will do so.

9. Changes

This policy may be updated as network conditions, threats and law evolve. The effective date records the current version. Continued use of the services after an update constitutes acceptance.
